Behold Terms of Use

Introduction
These Terms of Use ("Terms") are a legally binding agreement between you and Behold Infinity, Inc. ("Behold," "we," "us," or "our") governing your access to and use of our website, mobile application(s), and related services.
1. Scope of these Terms
Behold operates:
- the website located at https://www.trybehold.com (the "Site");
- the Behold mobile application(s) (the "App") when available; and
- any content, features, communications, and services that refer or link to these Terms (collectively, the "Services").
By using the Services, you agree to these Terms and our Privacy Policy, which is incorporated by reference.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.
2. Eligibility
You must be at least 13 years old to use the Services. If you are between 13 and 17, you represent that you have permission from a parent or legal guardian to use the Services.
3. Changes to these Terms
We may modify these Terms from time to time. We will update the "Last updated" date above. Your continued use of the Services after changes become effective means you accept the revised Terms.
4. Pre-launch signups, waitlist, and communications
Waitlist / account.
The Site may allow you to join a waitlist or create an account by providing information such as your name and email address. You agree your information will be accurate and kept up to date.
Messages.
By signing up, you agree we may send you service-related messages (e.g., confirmations, product updates, invitations, access notifications). Where permitted by law (and/or with your consent), we may also send marketing messages. You can opt out of marketing messages via the unsubscribe link or by contacting welcome@trybehold.com.
Early access / beta.
If we provide early access or beta features, you understand they may be experimental, may change, and may be discontinued at any time.
5. License to use the Services
Subject to your compliance with these Terms, Behold grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
We reserve all rights not expressly granted to you.
6. Intellectual property
The Services (including all software, code, designs, text, audio, video, graphics, logos, and trademarks) are owned by Behold or its licensors and are protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works, sell, lease, reverse engineer, decompile, or exploit any part of the Services except as expressly permitted by these Terms or by written permission from Behold.
7. User content and feedback
If you submit content to the Services ("User Content"), you retain ownership of your User Content, but you grant Behold a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use your User Content as necessary to operate, provide, and improve the Services.
If you provide ideas, feedback, or suggestions ("Feedback"), you agree Behold may use it without restriction or compensation.
8. Prohibited activities
You agree not to:
- use the Services for unlawful, harmful, or fraudulent purposes;
- interfere with the Services' security or operation;
- attempt unauthorized access to accounts, data, or systems;
- scrape/crawl the Services without permission;
- reverse engineer or attempt to extract source code;
- transmit malware or harmful code;
- impersonate others or misrepresent affiliation; or
- use the Services to build a competing product (except where prohibited by law).
We may suspend or terminate access if we believe you violated these Terms.
9. Third-party services; Apple App Store and Google Play
The Services may include links to third-party websites or services. We do not control and are not responsible for third-party content, services, or policies.
If you download the App through the Apple App Store or Google Play Store, your use may also be subject to Apple's or Google's terms and policies. Behold is not responsible for Apple's or Google's acts or omissions.
10. Important disclaimer (no professional advice)
Behold may provide spiritual, religious, historical, educational, or reflective materials. Behold does not provide medical, psychological, legal, financial, or other professional advice. You are responsible for how you interpret and use the content.
If you require authoritative religious guidance, consult qualified scholars. If you are experiencing distress or a mental health crisis, seek professional help immediately.
11. Purchases and subscriptions (in-app purchases)
If the App offers subscriptions, trials, or in-app purchases, billing may be handled by the platform provider (Apple or Google) and is subject to that platform's terms and policies. Behold does not process or store your full payment card information for purchases processed by Apple or Google. Apple/Google may provide us limited information (such as subscription status) so we can provide access to paid features.
Cancellation and refunds are handled through the platform provider, unless otherwise required by applicable law.
12. Termination
You may stop using the Services at any time. We may suspend or terminate access to the Services at any time, with or without notice, including if we believe you violated these Terms or if we discontinue the Services.
Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and dispute provisions).
13. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted, secure, or error-free operation.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEHOLD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEHOLD'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO BEHOLD FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the maximum extent permitted.
15. Indemnification
You agree to defend, indemnify, and hold harmless Behold and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services, (b) your User Content, or (c) your violation of these Terms or applicable law.
16. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where your jurisdiction's consumer protection laws require otherwise.
17. Disputes
You agree to attempt to resolve disputes informally by contacting welcome@trybehold.com first. If a dispute cannot be resolved informally, it will be resolved in accordance with applicable law.
